General & Cancellation Conditions
Cancellation fees:
- More than 2 months before departure: €200
- From 2 months to 30 days before departure: 50% of total price
- From 29 to 5 days before departure: 75% of total price
- Less than 5 days before departure: 100% of total price
Annulation par la société / Company cancellation
In case of cancellation by TSANGA TSANGA SOA s.a.r.l., shipowner and operator of NOFY BE, a refund of the deposits paid, without interest, up to a maximum equivalent to the portion of the service not provided, will be made by bank transfer.
Responsabilité / Responsibility
However, TSANGA TSANGA SOA s.a.r.l. cannot be held liable for any refund or be held responsible for the consequences of events external to it, notably:
Documents d'identité / Identity documents
Failure to present or presentation of expired identity documents or with insufficient validity period or not conforming to the indications on the registration form, and/or at the customs or registration police post. In case of registration failure (including for boarding delay), 100% of the trip price will be retained as cancellation fees.
Incidents tiers / Third party incidents
Unpredictable and insurmountable incidents or events by a third party such as: wars, political troubles, strikes external to TSANGA TSANGA SOA, riots foreign to TSANGA TSANGA SOA, technical or administrative incidents external to TSANGA TSANGA SOA, bad weather, breakdowns, loss or theft of luggage or other personal effects of travelers. The delay(s) suffered originating from the cases mentioned above as well as the program modifications that might result from them cannot lead to any compensation from TSANGA TSANGA SOA, notably due to the modification of the initially planned trip duration or delay at an air stopover. Any additional costs related to these disruptions (taxes, hotel, parking, repurchase of transport tickets...) will remain at the traveler's expense.
Force majeure
Cancellation imposed by circumstances having a 'force majeure' character, and/or for reasons related to maintaining traveler safety, and/or injunction from an administrative authority. TSANGA TSANGA SOA reserves the right to modify the planned dates, schedules or itineraries if it judges that traveler safety cannot be ensured, without the latter being able to claim any compensation.
'Force majeure' means any cause directly attributable to acts, events, non-occurrences, omissions, accidents or natural disasters independent of the will of TSANGA TSANGA SOA s.a.r.l., or the Crew, including, among others, strikes, lockouts and other social conflicts, social unrest, riots, acts of terrorism, blockade, invasion, war, fire, explosion, sabotage, storm, collision, grounding, fog, governmental act or regulation, contaminated fuel, major mechanical or electrical breakdown independent of the Crew's will.
Juridiction / Legal jurisdiction
These General and Cancellation Conditions are governed and interpreted in accordance with the laws of the Republic of Madagascar. Persons participating in one of our cruises and registered on our Registration Form and Contract agree to submit to the exclusive jurisdiction of Madagascar courts for any dispute arising from events related to this circuit or cruise.
